The Occupational Safety and Health Administration’s (OSHA) recordkeeping requirements (29 CFR Part 1904) mandate that covered employers record certain work-related injuries and illnesses on their OSHA 300 log. COVID-19 can be a recordable illness if a worker is infected as a result of performing their work-related duties. In order for employers to be responsible for the recording of COVID-19 cases, ALL of the following must be true:
- The case is a confirmed case of COVID-19 (see )
- The case is work-related (as defined by (b)(1))
- The case involves medical treatment beyond first aid or any of the more general recording criteria (set forth in )
On March 11, the World Health Organization (WHO) declared COVID-19 a global pandemic, and the extent of transmission has been rapidly evolving. OSHA recognizes that as there are increasing numbers of places where there is ongoing community transmission, institutions may have difficulty making determinations of work-relatedness. In light of those difficulties, OSHA has announced they are exercising their enforcement discretion (). OSHA will not enforce 29 CFR 1904 to require many employers to make work-relatedness determinations on confirmed COVID-19 cases except where there is objective evidence that is reasonably available to the employer. They believe this temporary enforcement policy will help employers to focus their response efforts on implementing good hygiene practices in their workplace and otherwise mitigating COVID-19s effects.
